Terms of use
DraftVersion 0.1Updated on October 13, 2026
These are the rules for using Deveras. They are written in plain language and short sections. If anything is unclear, write to us at hola@deveras.app.
This is a courtesy translation. The Spanish version is the one that applies. Read the Spanish version
01What Deveras is, and what it is not
Deveras is a rental listings platform that starts in Playa del Carmen, Quintana Roo. It lets people publish listings, find them, and get in touch with whoever is advertising. Using Deveras is free.
So there is no doubt about our role:
- We do not handle money. We do not collect, hold or transfer rent, deposits, holding payments or commissions. Every payment is made directly between the people involved, outside Deveras.
- We are not a party to your contracts. A lease is between landlord and tenant; a commission agreement is between the people who sign it. The contract templates we offer are general tools, not legal advice: you choose to use them and you are responsible for what you sign.
- We are not a real-estate agency. We do not represent either side, negotiate for anyone, show properties or manage them, and we receive nothing when a rental goes through.
- We do not own the properties and we do not visit every listing. Each listing is written and published by its advertiser.
Verifications, reviews and reports reduce risk; they do not remove it. Always visit the property, and never pay anything before you have seen it.
02Who operates Deveras
Deveras is operated by [PENDIENTE: razón social de la empresa operadora], registered address [PENDIENTE: domicilio completo en México], Mexican tax ID (RFC) [PENDIENTE: RFC] (“we”, “us”). You can reach us at hola@deveras.app or by phone at [PENDIENTE: teléfono de atención].
03When these terms apply
By creating an account you accept these terms, and we keep a record of the date and the version you accepted. If you only browse without an account, the general rules for using the site apply to you, including the rule against automated data extraction.
You must be at least 18 years old and legally able to enter into contracts. If you use Deveras on behalf of a company or agency, you confirm that you can bind it.
04Your account
- You sign in with your Google or Facebook account. We never see or store your password for those services.
- One person, one account. Do not open several to get around a suspension, boost your reputation or credit yourself with leads, and do not open one in someone else’s name without their permission.
- Use your real name or the business name you work under, and keep your details up to date.
- You are responsible for what is done from your account. If you think someone else got in, tell us straight away.
- You can close your account whenever you like, at no cost and without giving a reason (see Suspension and closing your account).
05Verifications and badges: what they mean
Verifications are optional. Each badge says what was checked and on what date, and nothing more:
- E-mail, Google or Facebook: the person signed in with that account.
- Phone: the person received a code on that number on the date shown.
- Identity: a specialised external provider compared an official document with a selfie of the person and told us the outcome. We do not see or store the document.
- Agent licence (matrícula): a member of our team reviewed the document the agent uploaded and compared it with their account details. It does not replace checking the state authority’s official register.
- Verified property: a member of our team reviewed a document that links the advertiser to the property (for example a title deed, a property-tax bill or the owner’s authorisation).
A badge is not a guarantee. It does not promise that the person will do what they say, that the document was not altered, that the property is free of legal problems, or that nothing has changed since the review. We may remove a badge if we receive information that contradicts it.
The trust level shown on a profile is calculated automatically from these verifications and from reviews. The privacy notice explains how it is calculated and how to object.
06Rules for publishing a listing
When you publish a listing, you confirm that:
- You have the right to advertise it. You own the property or you are authorised by whoever can rent it out (as an agent, a manager, or a co-owner with the others’ agreement). We may ask you to prove it.
- What you say is true. Price, location, size, condition, included services, requirements and photos match the real property. If you know of a significant defect, you say so.
- The price is the price. You publish the rent you will actually ask for, plus any compulsory extra costs (maintenance fees, deposit, legal policy, commission charged to the tenant). No bait prices.
- One property, one listing. You do not duplicate the same property to take up more space, and you do not republish a listing that was removed for breaking these rules.
- You keep it up to date. You confirm availability when we ask, and you pause the listing or mark it as rented as soon as it is no longer available.
- You do not discriminate. You do not exclude anyone or set conditions based on nationality, origin, skin colour, gender, sexual orientation, religion, disability, age, marital status, pregnancy, family situation or any other personal characteristic protected by law. You may set objective requirements that are the same for everyone (proof of income, guarantor, legal policy, pet rules).
- You respect the building’s rules. If the property is in a condominium, its regulations allow the use you advertise.
- The content is yours, or you have permission. The text and photos are yours or you are authorised to use them (see the review and content policy).
Contact details go in the fields provided for them, not in the title, the description or the photos: that is how we keep them out of public pages and out of the API.
07Vacation rentals
If you advertise short stays (by the night or by the week) in Quintana Roo, you may only publish the listing if you hold a current registration in the State Tourism Registry (Retur-Q) and the municipal permits that apply to your property. By publishing, you confirm that you have them. We may ask for the certificate and remove the listing if you do not provide it or if it has expired.
Lodging taxes (the state lodging tax, VAT and income tax) are the host’s responsibility. Because Deveras takes no part in payment, it does not withhold or remit taxes for you.
08What is not allowed
- Scams and deception. Advertising properties that do not exist, that you cannot rent out, or that you copied from someone else; pretending to be another person.
- Asking for money before a visit. Do not ask for deposits, holding payments, advances or “processing fees” before the interested person, or someone they trust, has visited the property. Do not ask for payment by methods that cannot be traced or reversed (money-transfer services, gift cards, cryptocurrency).
- Extracting data. Collecting listings, profiles, messages or contact details in an automated or bulk way (scraping), or using contact details obtained here to send unsolicited advertising. To reuse public listings, there is the open API.
- Fake reviews. Writing or commissioning reviews about rentals that did not happen, reviewing yourself, offering or asking for something in exchange for a review, or threatening someone with a review to get something.
- Self-referral. Using your own share link, another account of yours, or the account of someone in your own agency to credit yourself with a lead or points you did not bring in.
- Harassment and discrimination. Insults, threats, unwanted sexual messages, hate speech or discriminatory treatment.
- Harming the service. Introducing malicious code, getting around limits or security measures, overloading the site, or accessing other people’s accounts or data.
- Illegal uses. Any use that is against Mexican law.
If you see anything like this, report it.
09Deals and payments between people
Whatever you agree between yourselves (visits, price, deposit, contract, commission) is a deal between you. Deveras does not negotiate it, does not guarantee it and takes no part in payments. For your own safety:
- Visit the property before paying anything.
- Ask for a written contract and a receipt for every payment.
- Pay by traceable means, to the person who signs the contract.
- Be wary of prices far below the market and of anyone who rushes you.
10Your content and the licence you give us
The text, photos and everything else you publish remain yours. You can publish them anywhere else too: we do not ask for exclusivity.
So that we can display them, you give us a licence with these features:
- Non-exclusive, and at no cost to you. In return, we publish, translate and distribute your content without charging you.
- Limited to operating and promoting Deveras. Displaying your content on the site; adapting it technically (image sizes and formats); translating it; creating the previews that appear when it is shared; including it in search results, service e-mails and notifications; and using it to make Deveras known (for example in search engines and on social networks).
- It includes the open API. The public part of your listings (text, photos, price, approximate area, features and your public advertiser profile) may be reused by third parties through our API, the widget and the server for AI assistants, on one condition: they must display a visible mention of Deveras and a link to your listing. Your contact details, the exact address and your identity data are never provided that way.
- Temporary. It lasts while your content is published and for up to 12 months afterwards, solely for archiving, backup, handling complaints and proving what was published. When you remove a listing it stops being shown on Deveras and offered through the API; those who reuse it must remove it within 24 hours, although we cannot guarantee that all of them will do so in time.
- Valid worldwide, because the site can be viewed from any country.
- It does not include selling your content or passing it to third parties for any purpose other than those above.
You accept this licence in writing, electronically, when you create your account and each time you publish. You confirm that you hold the rights to what you publish and, if recognisable people appear in your photos, that you have their permission.
If your listing is copied. You authorise us, without obliging us, to ask other sites and platforms on your behalf to remove unauthorised copies of the listings you published on Deveras. You can withdraw this authorisation at any time by writing to us.
11Reviews and the right of reply
- Only a rental confirmed by both parties on Deveras can be reviewed.
- Reviews are published blind: neither side sees the other’s review until both have written theirs or 14 days have passed since the first one.
- The person reviewed has a right of reply: a public reply shown next to the review.
- Any review can be reported. We remove those that break the review and content policy; we do not remove them just because they are negative.
Reviews express the experience and opinion of the person who wrote them, not those of Deveras.
12Share links, leads and commission sharing
Every account can share listings with a personal link. These are the rules between users; by sharing with your link or by publishing a listing, you accept them:
- First contact wins. If someone arrives through a share link and sends an enquiry within the following 30 days, the lead is recorded under the name of the person who shared that link. The first link they arrived through counts, not the last.
- Existing client. If the advertiser had already received an enquiry from that person on Deveras, nobody can claim them afterwards.
- No self-referral. Your own links do not count, nor do those of other accounts used on your device, nor those of someone in the same agency as the advertiser.
- The advertiser may object to an attributed lead, giving a reason, within the following 24 hours. If they do not, it is treated as accepted.
- Commission sharing is only between agents with a verified licence. An advertiser can state in a listing that they share their commission, and what percentage. That percentage is recorded on the lead at the moment it arrives, and is only offered to someone whose state real-estate licence (matrícula) is verified on Deveras. Other people who share receive no commission: the lead is recorded under their name and earns reputation points.
What Deveras does and does not do. We record, with date and time, who shared, when the lead arrived, the percentage offered, any objections, and whether the person who shared confirms they received their part. That record can serve you as evidence. But we do not collect, split, guarantee or enforce the payment of any commission, and we do not decide who is right if there is a disagreement. The commission is settled directly between the agents, with whatever agreement and tax receipts apply to them.
Reputation points have no monetary value and cannot be exchanged for money. We may cancel attributions and points obtained by cheating.
13Automatic translations and artificial intelligence
Some features use artificial intelligence (AI):
- Automatic translation of listings (Spanish, English and French) and of chat messages.
- Reading listings. If you give us a screenshot or a piece of text, we extract the facts to pre-fill your listing.
- Photo analysis of your listings, to suggest descriptive tags.
- Natural-language search. We interpret what you type and turn it into filters.
What the AI produces is shown as a suggestion or as an automatic translation, and it can contain mistakes: a translation may shift a nuance, a tag may describe a photo wrongly, a search may misunderstand what you asked for. That is why:
- The advertiser reviews and corrects the suggested facts before publishing, and is responsible for the listing as published.
- If a translation and the original text differ, the text in the original language of the listing or message prevails.
- Removing a listing or suspending an account following a report is always decided by a member of our team, not by a program.
Do not upload identity documents to these features, or other people’s data that does not need to be shared.
14Open API and reuse of listings
Public listing data can be reused free of charge through our API, under the reuse licence: a visible mention of Deveras and a link to each listing. The API does not provide contact details, exact addresses or identity data.
Outside the API, copying the site’s content in an automated or systematic way is not allowed.
15What is ours
The name Deveras, its logo, the design of the site, its code and the database that organises the listings belong to us or are used under licence. These terms give you no rights over them beyond using the service and what the reuse licence allows.
16If something on Deveras infringes your rights
If you believe some content uses your photos, your text or your trademark without permission, or infringes another right of yours, report it or write to hola@deveras.app telling us who you are, which content it is (with its link), which work or right is affected, and why you believe its use is not authorised.
We will review it and, where appropriate, remove it promptly. We will tell the person who published it, who may explain why they believe they do have the right to use it.
17Free, and what would happen if something stopped being free
Today every feature of Deveras is free. If we ever offer paid features, we will tell you the total price and the conditions beforehand, we will never charge you without your express consent, and you will be able to cancel them immediately.
18Liability: what we answer for, and what we do not
What we answer for. Running Deveras with reasonable care; carrying out verifications as we describe them; handling your data in line with the privacy notice; dealing with reports; and any harm we cause through our own fault or bad faith.
What we do not answer for. Because we are not a party to rentals and take no part in payments, we are not responsible for:
- the truthfulness, accuracy or lawfulness of the listings, profiles, messages and reviews that users publish;
- whether a property exists, is available, is in good condition or can lawfully be rented;
- the conduct of users, on or off Deveras, or the performance of their contracts, payments, deposits or commissions;
- mistakes in automatic translations and AI suggestions;
- what third parties do with the public data they reuse through the API;
- interruptions or failures that are outside our control. Deveras is free and provided as it is: we work to keep it running well, but we do not promise that it will always be available or free of errors.
Your rights do not change. Nothing above limits the rights the law gives you as a consumer, or our liability in cases where the law does not allow it to be excluded or limited.
Your responsibility. You are responsible for what you publish and what you do on Deveras. If a third party makes a claim against us over content of yours that breaks these terms or the law, it is for you to deal with that claim to the extent that the harm is down to you.
19Suspension and closing your account
You can leave whenever you want. To close your account, write to hola@deveras.app from the e-mail address you sign in with. We do it at no cost and without asking why. Your listings stop being shown, and your data is handled as the privacy notice explains.
We may act if these rules are broken. Depending on how serious it is: asking you to correct something, pausing or removing a listing or a review, removing a badge, cancelling attributions or points, limiting features, or suspending or closing the account. In serious cases (signs of a scam, impersonation, risk to other people) we act immediately and without prior notice.
We will tell you what we did and why, unless the law or other people’s safety prevents it. If you think we got it wrong, you have 15 days to ask us to look again, by writing to hola@deveras.app.
We may keep the information needed to stop a suspended account from registering again and to deal with claims.
20Changes to the service and to these terms
Deveras evolves: we may add, change or withdraw features.
If we change these terms in a significant way, we will let you know by e-mail or on the site at least 15 days before the change applies, and you will always see the date of the last update here. If you disagree, you can close your account before that date; if you keep using Deveras afterwards, you are taken to accept the new version. Changes do not apply retroactively.
21Governing law and courts
These terms are governed by the laws of Mexico. For any dispute, the parties submit to the competent courts of Playa del Carmen, municipio de Solidaridad, Quintana Roo.
If you use Deveras as a consumer, you always keep your right to go to the Federal Consumer Protection Agency (PROFECO) and to the courts the law lets you choose. Before any formal complaint, write to us: almost everything can be sorted out by talking.
If any part of these terms turns out to be invalid, the rest still applies.
22Languages
These terms were written in Spanish. This English version is a courtesy translation, as is the French one; if there is any difference, the Spanish version prevails.
